Welcome to our Web site. By using our site, you agree to comply with and be bound by this Terms of Use Agreement (“Agreement”). If you do not agree to all of these Terms of Use, do not use this site. When using our Site, information will be transmitted over a medium that may be beyond the control and jurisdiction of Canadian Blood Services. All rights reserved.’ Any other use of the material is strictly prohibited without our prior written permission and the permission of applicable rights holder(s). 4. Release and Indemnity of Canadian Blood Services

You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, advertisers, product and service providers, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable legal fees, related to your violation of this Agreement or use of the Site. You also agree to release and hold harmless Canadian Blood Services from and against any and all liability, claims damages, actions, and costs, arising out of or in connection with your use, review or reproduction of the Canadian Blood Services Site.

5. System Integrity

You may not use any device, software or routine to interfere or attempt to interfere with the proper working of the Canadian Blood Services Site. You may not take any action, which imposes an unreasonable or disproportionately large load on Canadian Blood Services infrastructure.

6. Web Site Linking

Links to other Web sites or references to other organizations, products, services or publications do not constitute endorsement or approval by Canadian Blood Services and Canadian Blood Services makes no representations whatsoever about any other Web site which you may access through this one. Canadian Blood Services cannot and does not warrant the accuracy, completeness, timeliness, non-infringement, merchantability or fitness for a particular purpose of any information available through these links and disclaims any opinions expressed on such sites.

7. Advertisers

The Site may contain advertising and sponsorships. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site is accurate and complies with applicable laws. We are not responsible for the illegality or any error, inaccuracy or problem in the advertiser’s or sponsor’s materials.

8. Accurate Information

Certain sections of, or offerings from, the Site may require you to provide identifiable personal information or to create an online account. If identifiable personal information is requested, you agree to provide us with your real name and accurate, complete information. Creating an online account must be done using your real name and accurate information. Each account is for your personal use only and not on behalf of any other person or entity. We do not permit (a) any other person using your online account; or (b) access through a single name being made available to multiple users on a network. You are responsible for preventing such unauthorized use. You may deactivate your online account at any time. Any unused online accounts will be deactivated by us after 365 days.

9. Password

In order to create an online account, you must choose a username and password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another individual at any time. You agree to notify Canadian Blood Services immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your online account.

10. Errors, Corrections and Changes

While every effort has been made to ensure the accuracy and veracity of the information on this Web Site, Canadian Blood Services is not responsible in any way for damages arising out of the use of this Web Site. And, although Canadian Blood Services relies on reputable sources and attempts to keep the information current, Canadian Blood Services does not warrant the accuracy or completeness of the information. We do not represent or warrant that the Site will be error-free, free of viruses or other harmful components, or that defects will be corrected. We may make changes to the features, functionality or content of the Site at any time. We reserve the right in our sole discretion to edit or delete any documents, information or other content appearing on the Site.

11. Limitation of Liability

Canadian Blood Services shall not be liable to you and/or any third party for any damages of any kind arising out of or relating to the use of, or reliance upon, our Site including, but not limited to, any lost profits, lost opportunities, special, incidental, indirect, consequential or punitive damages, regardless of your advice to the contrary.

12. Unlawful Activity

We reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, e-mail addresses, usage history, posted materials, IP addresses and traffic information.

13. Nontransferable

Your right to use the Site is not transferable or assignable. Any password or right given to you to obtain information or documents is not transferable or assignable.
